Terms of Service

PERSONA is where you chat, messenger-style, with AI friends you set up yourself. Please read the terms below before you start.

Article 1 (Purpose)

These Terms set out the rights, obligations and responsibilities of [Company name] (the “Company”) and its members, and other necessary matters, in connection with the use of “PERSONA”, the AI persona messenger service provided by the Company (the “Service”).

In these Terms, “persona” means an AI conversation partner as defined in Article 2, and the service itself is referred to as the “Service”.

Article 2 (Definitions)

  • “Member” means a person who has agreed to these Terms and signed up for the Service.
  • “AI persona” (“persona”) means a virtual conversation partner whose replies are generated by artificial intelligence according to settings chosen by a member, such as name, personality and speech style. A persona is not a real person.
  • “Creator” means a member who has published a persona they created on the Market.
  • “Market” means the space where other members can browse personas published by creators and add them as friends.
  • “Adding a friend” means a member adding a persona from the Market as one of their own conversation partners.
  • “Energy” means a unit representing usage of the Service, such as AI conversations, calculated on the basis of the actual cost of AI usage.
  • “Voice time” means a time-based allowance used to listen to a persona's replies as audio.
  • “Coins” means an in-service means of payment used to add paid personas as friends on the Market.
  • “Native language” means the language a member chooses from Korean, English, Japanese and Chinese when signing up. Members can chat with personas in their native language free of charge.
  • “Language Pack” means a monthly add-on subscription (Language Pack 1, Language Pack 2, Total Language Pack) that lets personas chat in languages other than the member's native language.
  • “Paid services” means services that members pay for, such as subscription plans, Language Packs, energy, voice time and coins.

Article 3 (Posting and amendment of these Terms)

The Company posts these Terms within the Service so that members can easily view them.

The Company may amend these Terms to the extent that doing so does not violate applicable laws. When amending the Terms, the Company will announce the amendment, stating its effective date and the reasons for it, from 7 days before the effective date. Amendments that are unfavorable to members will be announced from 30 days before the effective date and notified to members individually.

Members who do not agree to the amended Terms may terminate their service agreement.

Article 4 (Service agreement and age requirements)

The service agreement is formed when a person applying to sign up agrees to these Terms and the Privacy Policy, confirms that their conversation partners are AI, and the Company accepts the application.

Only people aged 14 or older may sign up for the Service. Members must enter their correct year of birth when signing up, and use of the Service may be restricted if a member signed up with false information.

Adult features, such as the 19+ setting, are available only to members who have verified through an identity verification agency that they are aged 19 or older. Adult expressions are not applied until adult verification is completed.

Review note · Need to confirm how identity verification agencies (mobile phone, PASS, etc.) will be integrated and whether obligations under the Youth Protection Act (청소년보호법) apply.

Article 5 (Notice about AI services)

Messages sent by personas in the Service are generated by artificial intelligence. The Company indicates throughout the Service that personas are AI, and a persona will not hide the fact that it is an AI when a member sincerely asks.

  • Responses generated by AI may be inaccurate or inappropriate. Do not rely solely on AI responses when making important decisions.
  • Persona responses do not replace advice from professionals in areas such as medicine, law or finance.
  • Personas are not real people, and what a persona says does not represent the views of the Company or the creator.
  • If a crisis such as self-harm or suicide is suspected, the Service shows information about counseling services. In an emergency, contact the Suicide Prevention Hotline at 109, the Mental Health Crisis Line at 1577-0199 (24 hours), or 112/119 immediately.

Review note · Need to confirm the scope of the generative AI notice obligation under the Framework Act on the Development of Artificial Intelligence and the Establishment of Trust (인공지능 발전과 신뢰 기반 조성 등에 관한 기본법) and how the notice must be displayed.

Article 6 (Services provided)

The Company provides the following services.

  • Creating personas and changing their settings
  • One-on-one chats with personas, and group chats in which several personas and members take part together
  • Memory organization and closeness features based on conversations
  • Listening to persona replies as audio
  • Publishing on the Market, adding friends, ratings and reports
  • Other features that the Company additionally determines and provides

Advertisements may be displayed within the Service for free users and on some plans.

Article 8 (Canceling a subscription)

Members can cancel automatic renewal at any time under [More > Plan]. Even after canceling, the member can keep using the benefits of the plan until the end of the period already paid for. When that period ends, the member is moved to the free Trial plan.

When the period ends, any remaining monthly energy and monthly voice time expire, but purchased energy, voice time and coins, as well as friends and chat history, are kept.

Automatic renewal of a Language Pack can also be canceled at any time on the same screen, and the Language Pack remains available until the end of the period already paid for. When the Language Pack period ends, personas set to that language chat in the member's native language, and friends and chat history are kept as they are.

Article 9 (Withdrawal of purchase and refunds)

Under the Act on the Consumer Protection in Electronic Commerce, etc. (전자상거래 등에서의 소비자보호에 관한 법률), members may withdraw a purchase of paid services within 7 days from the date of purchase.

However, where provision of digital content has begun, such as energy, voice time, coins or subscription benefits, withdrawal may be restricted under the same Act. The Company clearly informs members of this before payment, and accepts withdrawal for the unused portion of products that can be used in separate parts.

Amounts paid in error (overpayments) are refunded by the same method used for payment. Where a refund cannot be made by the same method, the Company refunds the amount by a method agreed with the member.

Withdrawals and refunds can be requested at [Customer support contact].

Review note · Need to finalize when use is considered to have begun (e.g., whether using part of the energy counts as starting to use all of it), the formula for partial refunds, and who is responsible for refunds of in-app purchases made through app stores.

Article 10 (Market and creators)

Members on a plan that includes Market publishing can publish personas they have created on the Market. The Company may run automated checks before publication, and publication of a persona that violates these Terms or the operating policies may be refused or suspended.

The Market displays information that the creator has chosen to make public, such as the persona's name, introduction, tags and speech style preview. Detailed settings, such as the persona's background, are not disclosed to other members.

Conversations and memories that other members have with a persona after adding it as a friend are not disclosed to anyone, including the creator.

Creators are responsible for the settings of the personas they publish and must not infringe the rights of others.

Review note · Need to finalize whether members who have already added a persona as a friend keep their conversations when that persona's publication is suspended or deleted, and how coins are handled in that case.

Article 11 (Revenue sharing with creators)

The Company shares part of the revenue generated through use of the Market with creators according to the following criteria.

  • Add-friend revenue: ₩40 for each coin that other members spend to add the creator's persona as a friend
  • Chat royalties: ₩0.025 for each unit of energy that members who added the persona as a friend spend chatting with that persona
  • Usage from creators chatting with their own personas is not counted toward royalties.

Creators can request a payout once their accumulated revenue reaches ₩10,000 or more. Revenue paid to individual creators is paid after business income tax (3.3%) is withheld under the applicable tax laws.

Revenue generated by fraudulent means (self-dealing, automated use, etc.) is not shared, and if it has already been paid, the Company may recover it.

If the sharing criteria change, the Company will give advance notice in accordance with Article 3.

Review note · Tax review needed on the classification of income subject to withholding (business income or other income), the payout cycle, the payment method, and the information required to request a payout (legal name, bank account).

Article 12 (Prohibited conduct)

Members must not engage in any of the following conduct while using the Service. This applies equally to persona settings, Market introductions and conversations.

  • Creating or requesting sexual content that treats minors as sexual objects or evokes minors (this is never permitted under any circumstances and may be reported to the relevant authorities)
  • Impersonating real people such as celebrities, or depicting real people in a sexual or insulting manner
  • Hateful or discriminatory expression based on gender, region, disability, nationality, race, religion, sexual orientation or similar grounds
  • Creating or distributing obscene material, illegally filmed material, or content that promotes violence or self-harm
  • Entering other people's personal information, or having a persona collect it
  • Infringing the rights of others, such as copyrights, trademark rights or portrait rights
  • Mass-generating conversations with automated tools, or attempting to circumvent the Service's security or billing systems
  • Buying or selling coins or accounts, or transferring them to others

If the Company confirms prohibited conduct, it may make the content private or delete it and, depending on the severity of the violation, restrict the member's use of the Service temporarily or permanently.

Article 13 (Content reports and actions)

Members can report personas or messages that violate these Terms or the operating policies using the report feature within the Service. The reporter's information is not disclosed to the person reported.

When the Company receives a report, it reviews the report within [Review period] and takes any necessary action. A Market persona that has accumulated reports from a certain number of different members or more may be automatically unpublished until the review is completed.

Members who disagree with an action taken may file an objection at [Customer support contact], and the Company will review the matter again and notify the member of the result.

Article 14 (Rights to posted content)

Rights to content posted by a member, such as persona settings and Market introductions the member has created, belong to that member.

Members permit the Company to use their posted content free of charge to the extent necessary to operate and improve the Service and to display the content on the Market. This permission ends when the member deletes the content or leaves the Service. Personas that other members have already added as friends are handled according to [Policy to be finalized].

Review note · Review needed on who holds the rights to conversation content generated by AI and the scope of its use.

Article 15 (Changes to and suspension of the Service)

The Company may change parts of the Service as needed for operational or technical reasons, and will announce important changes in advance.

The Company may temporarily suspend the Service for unavoidable reasons such as equipment maintenance, outages, natural disasters or service interruptions by AI providers. If a member suffers loss in using paid services as a result, the Company will provide compensation in accordance with applicable laws and its operating policies.

Article 16 (Limitation of liability)

The Company does not guarantee the accuracy, completeness or fitness for a particular purpose of responses generated by AI. However, the Company is liable for damage caused to members by its willful misconduct or gross negligence.

The Company is not liable for damage resulting from a member's violation of these Terms or from disputes between members.

Article 17 (Dispute resolution)

These Terms and any disputes relating to use of the Service are governed by the laws of the Republic of Korea.

If a lawsuit is filed between the Company and a member, [Competent court] shall have jurisdiction. However, where jurisdiction is determined otherwise under applicable laws such as the Civil Procedure Act (민사소송법), those laws apply.
